Afección fiscal
A tax guarantee attached to the property that can answer for unpaid taxes linked to the sale.
The afección fiscal is a note whereby the property itself guarantees the payment of certain taxes linked to the transaction, for instance an ITP top-up claimed after a reassessment by the tax authorities. It is entered in the Registro de la Propiedad for a limited period.
If the authorities consider the tax base too low, they can claim an additional amount, the property remaining bound to that debt.
For the seller
This guarantee mainly protects the tax authorities against the buyer; on the sale side, a declared value that is too low exposes the buyer to a later tax adjustment.
