Cargas
Charges and debts encumbering a property, such as a mortgage or a seizure, entered in the registry.
Cargas are the legal or financial charges that weigh on a property: an outstanding mortgage, a seizure, an easement, a community debt. They appear on the nota simple from the Registro de la Propiedad.
In Spain, charges follow the property and not the person: a buyer who purchases without clearing them can inherit them.
For the seller
You must, in principle, sell the property free of charges; an outstanding mortgage is usually settled on the signing day out of the sale proceeds.
